Privacy Laws


Due to the rapidly increasing incidence of identity theft – and the increased awareness of the importance of protecting personal information – laws protecting personal information have been enacted in many countries worldwide. Although South African legislation has lagged a little, we will soon see the introduction of the Data Protection Act, ensuring that South African organisations have to take special care of how they of how they treat client information.

While South African corporates are subjected to the laws expanded upon in the section, subsidiaries of US and European corporates with offices in South Africa are also subject to the laws and regulations of their home country. This is especially the case for listed corporate. The US Privacy Laws are particularly onerous and expanded upon separately, as are the UK, Australian and Japanese equivalents.

Secure destruction and disposal is the law worldwide. Now it’s South Africa’s turn.
